By using our services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our services.

Nurtured Numbers provides the following products and services:

• Printed baby memory books: Personalized photo books created using data you provide from baby tracking apps, along with photos and personal notes. We design, print, and ship these books to you.
• Digital cards: Purchasable gift cards that can be redeemed toward any Nurtured Numbers product.

Our website and services are intended for adults. You must be at least 18 years old to create an account or place an order. Accounts may not be created or used by children.

Your book is a keepsake that presents the data you tracked, as you tracked it. It is not a medical record, a diagnostic tool, or health advice, and it should not be relied on for medical decisions.

• All orders are subject to acceptance and availability.
• Prices are listed in USD and may change without notice.
• Payment is required at the time of order.
• You are responsible for providing accurate shipping information.

• You retain ownership of all data, photos, and content you submit (“Your Content”).
• You grant us a license to use Your Content solely for the purpose of creating your book and fulfilling your order.
• You represent that you have the right to use and share all content you submit.
• You confirm that any person appearing in photos you upload (or their parent or legal guardian) has consented to the photo being used in your book.
• We may decline to print content that is unlawful, infringing, hateful, or that we reasonably believe we do not have the right to reproduce. If we decline an order for this reason, we will refund it.
• We are not responsible for any claims arising from Your Content.

After you submit your book, it is prepared and sent to print. You will receive status updates throughout the production process. Please review your book carefully before checkout, as changes cannot be made after submission.

• Estimated delivery times are approximate and not guaranteed.
• We are not responsible for delays caused by shipping carriers.
• Risk of loss passes to you upon delivery to the carrier.

• Due to the personalized nature of our products, we do not accept returns unless there is a printing defect or damage during shipping.
• If you receive a damaged or defective product, contact us within 7 days of delivery.
• Gift cards: Digital gift cards are non-refundable, non-exchangeable for cash, and have no expiration date. Gift cards may only be redeemed toward Nurtured Numbers products and cannot be combined with other gift cards.

Because our books are made to your specifications and clearly personalized, the 14-day cancellation (“cooling-off”) right under the Consumer Contracts Regulations 2013 (and equivalent EU rules) does not apply once we begin producing your book. We tell you this before you purchase.

Nothing in these Terms affects your statutory rights. If your book arrives damaged, defective, misprinted, or not as described, you retain your full remedies under the Consumer Rights Act 2015 (or equivalent local law), including repair, replacement, or refund, and those rights are not limited by the 7-day contact window or any other provision above.

If you are a consumer in the UK or EU, section 10 (Limitation of liability) and section 13 (Governing law) apply only to the extent permitted by the mandatory consumer protection laws of your country, and section 12 (Dispute resolution) does not prevent you from bringing proceedings in your local courts.

By opting in to receive SMS messages from Nurtured Numbers, you agree to the following:

• You consent to receive recurring automated marketing and transactional text messages from Nurtured Numbers.
• Message frequency varies based on your interaction with our services.
• Message and data rates may apply depending on your mobile carrier plan.
• You may opt out at any time by replying STOP to any message.
• For assistance, reply HELP or email us at admin@yournurturednumbers.com.
• Consent to receive SMS is not required as a condition of purchase.
• We will not share your phone number with third parties for marketing purposes.

All content on our website, including text, graphics, logos, and designs, is our property or the property of our licensors and is protected by copyright and trademark laws.

To the maximum extent permitted by law, Nurtured Numbers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

You agree to indemnify and hold harmless Nurtured Numbers from any claims arising from your use of our services or Your Content.

In the event of any dispute arising from these Terms or your use of our services, we encourage you to contact us first at admin@yournurturednumbers.com so we can attempt to resolve the matter informally.

If a dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in the State of South Dakota. Each party shall bear its own costs. Notwithstanding the above, either party may bring a claim in small claims court if the claim qualifies.

These Terms are governed by the laws of the State of South Dakota, without regard to conflict of law principles.

We may modify these Terms at any time. Your continued use of our services after changes constitutes acceptance of the new Terms.

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. We are not liable for delays or failures caused by events beyond our reasonable control, including carrier disruptions, print partner outages, natural disasters, or internet failures. These Terms, together with our Privacy Policy, are the entire agreement between you and Nurtured Numbers regarding our services.
